Legal
Terms, Privacy and Refunds
This page is the full agreement between you and Bot-Hosting.net. We have written it to be read, not to be skimmed past: what we sell, what we guarantee, what we explicitly do not guarantee, what we do with your data, and how to get your money back.
The essentials, in one box
- Who you are buying from
- Bot-Hosting.net, a business registered in France, SIREN 894 885 003. Full legal identity in section 8.
- What you are buying
- A subscription to application hosting. It renews automatically until you cancel.
- Price and tax
- From 1.99 EUR/month to 19.99 EUR/month. All prices are shown excluding VAT. VAT is added at checkout based on your billing country.
- Cancelling
- One click, any time, no fee. You keep the service until the end of the period you already paid for.
- Refunds
- Full refund within 24 hours of payment, no questions asked. EU consumers also keep a 14 day statutory right of withdrawal.
- Where your data lives
- On our nodes in the European Union and in the United States, depending on where you are placed. Section 6.2 names every provider. We never sell your personal data.
1. Terms of Service
1.1 Definitions
- We, us, our mean the operator of Bot-Hosting.net, identified in full in section 8.
- You, your, the customer mean the person or company holding an account.
- Deployment means one application, bot or database that we run for you inside an isolated container.
- Slot means one deployment allowance included in your plan.
- Pool means the total RAM, CPU and storage granted by your plan, which you allocate freely across your slots.
- Your content means the code, files, environment variables and data you upload or generate on the service.
1.2 Accepting these terms
By creating an account, deploying an application or paying for a plan, you accept these terms in full. If you do not accept them, do not use the service. If you are using the service on behalf of a company, you confirm that you are entitled to bind that company.
1.3 Eligibility and your account
- You must be at least 15 years old, or the minimum age of digital consent in your country if it is higher. If you are under 18, you may only take a paid plan with the consent of a parent or legal guardian.
- Accounts are created through Discord or GitHub. You are responsible for keeping those accounts secure, and for everything done through your Bot-Hosting.net account.
- One person, one account. Creating multiple accounts to obtain extra free resources or extra referral bonuses is a breach of these terms.
- You must give us an accurate billing address. It determines the VAT we are legally required to charge.
1.4 Your content stays yours
You keep all rights to your content. We claim no ownership over your code or your data. You grant us only the narrow, revocable licence we need to actually run the service: to store, copy, transmit and execute your content on our infrastructure, and to back it up.
You are responsible for having the right to use everything you upload, and for making sure your application complies with the rules of any platform it connects to, including the Discord Developer Terms of Service if you run a Discord bot.
1.5 What we may do
We keep the right to run the platform safely and lawfully. Specifically, we may:
- Inspect files and processes automatically where it is necessary to detect abuse, malware or resource attacks. We do not read your content for any other purpose.
- Suspend or throttle a deployment that destabilises a shared node, or that breaches section 5.
- Suspend or close an account that breaches these terms, that is used for illegal activity, or where payment fraud is suspected.
- Change plan contents, prices and these terms for the future. We describe how in section 1.8.
Except where the law, an urgent security risk or a serious abuse case makes it impossible, we tell you before we suspend you, and we tell you why. If we close your account for a breach you did not commit, we restore it.
1.6 Disclaimer
The service is provided with reasonable skill and care, but it is not fault free. We do not warrant that your own application will work, that it will be free of bugs, or that a third party service it depends on will stay available. Nothing in this section removes the legal guarantee of conformity that consumers have under French law.
1.7 Limitation of liability
Our liability towards a business customer, for any and all claims arising in a given period, is limited to the amount that customer actually paid us over the twelve months preceding the event. We are not liable to business customers for loss of profit, loss of business, loss of goodwill or loss of data.
For consumers, nothing here limits our liability where the law does not allow it, in particular in case of death or personal injury, gross negligence, or wilful misconduct. Because the service is not a backup service, and because we cannot guarantee data recovery, you should keep your own off-site copies of anything you cannot afford to lose. See section 2.
1.8 Changes to the service and to these terms
We may change these terms, the plan contents or the prices. We will announce any change that is unfavourable to you at least 30 days in advance, by email and in the dashboard. The change applies to your next renewal, never retroactively to a period you already paid. If you do not accept it, cancel before that renewal and you will not be charged the new price.
1.9 Governing law and disputes
These terms are governed by French law. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you may bring a claim before the courts of that country.
Talk to us first: write to [email protected] and we will answer within 48 hours. If we cannot agree, consumers in the EU may use the European Commission online dispute resolution platform at ec.europa.eu/consumers/odr. Failing that, the dispute goes to the competent French courts.
2. What our service actually guarantees
A promise you cannot verify is worth nothing. Here is exactly what we commit to, and, just as importantly, what we refuse to pretend.
- 99.9% monthly uptime target on paid plans, measured on the availability of the platform and of the node running your deployment.
- Automatic backups, kept for 1 to 30 days depending on your plan.
- A final backup before any deletion, whatever the reason for that deletion, kept for your plan's retention window.
- Advance warning before deletion: we notify you 6, 4, 2 and 1 day before a grace period expires.
- Named processors. Section 6.2 lists the companies that handle your data and the country each one sits in, and we keep that list up to date.
- A 48 hour support response target by email and on Discord. Advanced, Pro and Pro+ get priority support, Enterprise gets a dedicated contact.
- No hidden fees. No setup fee, no cancellation fee, no charge you did not see before confirming.
- The free plan carries no uptime commitment. It is provided as is, it may be moved or restarted without notice, and it requires a manual renewal every 4 days.
- We are not a backup provider. Keep your own off-site copies of anything critical.
- CPU is a fair share limit, not a reserved core. Infrastructure is shared, and performance can vary with neighbour load.
- You cannot choose where your deployment runs. We place it automatically on an available node, which may be in the European Union or in the United States. If you need a guaranteed region, contact us before subscribing.
- We do not guarantee that your own code works, nor that Discord, GitHub or any other third party your app depends on stays up.
- No automatic service credits. If we miss the target, contact us and we will review your case individually and in good faith.
2.1 What is excluded from the uptime target
- Maintenance announced in advance on status.bot-hosting.net, and emergency security maintenance.
- Failures caused by your own code, your configuration, or your resource limits being exhausted.
- Suspensions that follow a breach of section 5, or a non payment.
- Failures of an upstream provider or network outside our control, and force majeure.
- The free plan.
3. Billing and payments
3.1 Prices, tax and currency
- Paid plans run from 1.99 EUR/month (Starter) to 19.99 EUR/month (Enterprise). Yearly billing is available at a discount.
- All prices are displayed excluding VAT. VAT is calculated and added at checkout according to your billing country. The total you confirm on the Stripe checkout page is the total you pay.
- We bill in EUR, USD or GBP. Your currency is set at your first paid checkout and cannot be changed afterwards, because a single account cannot hold two currencies.
- Invoices are available at any time in your billing portal.
3.2 Renewal
Subscriptions renew automatically at the end of each period, monthly or yearly, on the payment method you registered, until you cancel. There is no trial period and no free period on paid plans: you pay for what you order, from the moment you order it.
3.3 Changing plan
- Upgrades apply immediately. You are charged the prorated difference for the rest of the current period, straight away. The new resources are granted only once that payment clears.
- Downgrades apply at the end of the current period and are never prorated. You keep what you paid for until then, and no refund is due for the unused difference.
- A downgrade is refused while your current usage exceeds the smaller plan's pool. Free up resources first.
- Moving from monthly to yearly applies immediately, with the difference prorated. Moving from yearly to monthly applies at the end of the year already paid, with no mid term refund.
3.4 Credits
- Credits are a prepaid balance. 1 credit equals 1 EUR, always, whatever your display currency. VAT is added on top at purchase.
- Credits can pay for your subscription. They never expire.
- Credits cannot be converted back into money and cannot be cashed out or transferred. An unspent top-up can still be refunded under section 4.
- If your balance is not enough to renew a credit funded plan, the account enters the grace period described in section 3.6.
3.5 The free plan and its 4 day renewal
The free plan is genuinely free, with no card required, and includes one slot. In exchange, it requires you to renew it manually from the dashboard every 4 days, which is how we keep abandoned bots from consuming a shared infrastructure forever. The renewal button unlocks 3 days before the due date. Free accounts also see partner promotions in the dashboard once they have a deployment older than 24 hours. Paid plans show no ads.
3.6 If a payment fails, your deployments are deleted. Read this one.
We would rather be blunt here than have you discover it the hard way.
- If a renewal payment fails, or if a free plan is not renewed in time, the account enters a grace period: 7 days on a paid plan, 3 days on the free plan.
- During the grace period your deployments keep running, and we email you at 6, 4, 2 and 1 day remaining.
- Update your payment method, or top up your credits, at any point during that window and everything resumes with nothing lost.
- When the grace period expires, all of your deployments are permanently deleted, including their files and their databases. We take one final backup first, and keep it for your plan's retention window (1 day on the free plan, up to 30 days on paid plans). After that window, it is gone for good, and we cannot recover it.
Note the difference with a normal cancellation: if you cancel (section 4.3), nothing is deleted. Deployments that no longer fit the free plan are simply paused.
3.7 Chargebacks
If something is wrong with a charge, email us. We answer within 48 hours and we refund readily where it is due, as set out in section 4. Opening a chargeback with your bank without contacting us first costs us a fixed fee and gives us no chance to fix your problem, so we may suspend or close an account while a chargeback we consider unfounded is open, and we will submit our records to the bank. If the chargeback turns out to be justified, we restore the account and apologise.
3.8 Referrals and partners
- Referring a user who launches their first deployment earns you 1 EUR of credit, and gives them 30% off their first payment. Credit, not cash: see section 3.4.
- Self referrals, duplicate accounts, shared IP addresses and VPN or proxy sign-ups are automatically rejected. Referral fraud voids the credits and can close the account.
- The Partner Program, which pays real commission by bank transfer or crypto, is a separate agreement. Apply at [email protected].
4. Refunds and cancellation
4.1 The 24 hour guarantee
If you are not satisfied, ask us within 24 hours of a payment and we refund it in full, no questions asked, back to the original payment method. Write to [email protected] from the email address on your account. Refunds are issued within 14 days, usually much sooner. Your bank may take a few extra days to show it.
4.2 Your statutory right of withdrawal (EU and EEA consumers)
This right exists on top of the guarantee above, and we cannot take it away from you. As a consumer you have 14 days from your order to withdraw from it, without giving a reason.
Because you ask us to start hosting immediately, you expressly request that performance begins during that period. That means that if you withdraw during the 14 days, we refund what you paid minus a proportionate amount for the part of the service already supplied up to the moment you tell us. In practice, on a monthly plan, that is a few cents per day of use.
To exercise it, send us an unambiguous statement at [email protected]. This right does not apply to business customers.
4.3 Cancelling
- Cancel in one click from your billing page, at any time. There is no cancellation fee and no notice period.
- Your plan stays active until the end of the period you already paid for. You are not charged again.
- At that point the account falls back to the free plan. Nothing is deleted. Deployments that no longer fit the free pool are paused, and you can restore them by resubscribing.
- You can undo a cancellation at any time before the period ends.
4.4 Outside those windows
After the 24 hour guarantee and after any statutory withdrawal period, subscription payments are not refundable, and we do not refund unused time on a period you chose to leave early or on a downgrade. Credits already spent are not refundable. Unspent credits from a top-up remain refundable to a consumer under section 4.2.
Those windows are a floor, not a ceiling. If we broke something, if you were charged twice, if a node failure cost you a period of service, or if you simply have a case worth hearing, write to us. We would rather refund you than argue with you.
4.5 Deleting your account
Deleting your account from the settings page cancels your subscription and permanently destroys your deployments, files, databases and backups. This is immediate and irreversible, and it does not trigger a refund of the current period. Download what you need first.
5. Acceptable use
You may run almost anything on our infrastructure. The list below is what we will suspend you for, without a refund, because it is illegal, because it harms other people, or because it destroys a shared platform.
5.1 Never allowed
- Anything illegal under French or EU law, and any handling of content that is illegal to hold, in particular child sexual abuse material, which we report to the authorities.
- Attacking other systems: DDoS tools, botnets, stressers, internet wide scanners, brute force or credential stuffing tools, exploit delivery.
- Malware, ransomware, phishing infrastructure, token stealers, spam or unsolicited mass messaging.
- Discord self-bots, mass account creation, raid tools, or anything that breaches the terms of a platform you connect to.
- Cryptocurrency mining, and any workload whose main purpose is to consume CPU rather than to serve users.
- Deliberately evading plan limits, for example by spreading one workload over several free accounts.
- Reselling raw compute or hosting to third parties without a written agreement with us.
- Storing personal data of other people without a lawful basis for doing so. If you do, you are the controller of that data and you carry that responsibility.
5.2 Fair use of shared resources
Your plan gives you a RAM, CPU and storage pool, and hard limits are enforced by the platform. Beyond those limits, we ask for common sense: a process that destabilises a node for its neighbours can be throttled, restarted or suspended even if it is technically inside your quota. We will always tell you why.
5.3 Enforcement and reporting abuse
Depending on how serious it is, we may warn you, throttle the deployment, suspend it, or close the account immediately. Serious cases, and legal orders, are acted on without notice. Suspension for a breach does not entitle you to a refund.
To report abuse, a copyright infringement or illegal content hosted by us, write to [email protected] with the URL or the deployment concerned, and a description of the problem. We answer abuse reports within 48 hours.
6. Privacy and data
The data controller is the operator identified in section 8. You can reach us about anything on this page at [email protected]. We do not sell your personal data, and we never have.
6.1 What we collect, and why we are allowed to
| Data | Why | Legal basis |
|---|---|---|
| Discord or GitHub identity: account id, username, avatar, verified email address | To create and authenticate your account, and to contact you about your service | Performance of the contract |
| Your country, derived from your connection | To apply the correct VAT rate and to suggest a currency | Legal obligation |
| Billing name, address and tax id | To invoice you. Collected and stored by Stripe, not by us | Legal obligation |
| Payment identifiers, invoices, credit balance and transactions | To take payment and keep accounts. We never receive your card number | Contract and legal obligation |
| Your content: code, files, environment variables, databases, backups | To run the service you are paying for | Performance of the contract |
| A GitHub access token, and an SFTP password, if you use those features | To pull your repositories and let you connect to your files | Performance of the contract |
| Activity logs, last seen time, and moderation records | Security, abuse investigation, and support | Legitimate interest in a safe platform |
| The IP address used at sign-up through a referral link, and whether it is a VPN or proxy | To stop referral bonus farming. Used for nothing else | Legitimate interest in preventing fraud |
| Audience measurement through Google Analytics | To understand which pages are used | Your consent |
6.2 Who else processes it, and in which country
These are the processors that handle your data on our behalf. We keep this list up to date, and you can ask us at any time who processes a specific piece of your data.
Be aware of what this table says: we do not host everything in Europe. Our nodes run on rented servers from several providers, some in the European Union and some in the United States, and we place your deployment on whichever has capacity. Your files, your databases and your backups therefore sit wherever that node is, and that may be outside the European Union. Where a transfer outside the EU takes place, it is covered by the European Commission Standard Contractual Clauses. If you need your data to stay in the EU, tell us before you subscribe and we will confirm whether we can place you there.
| Processor | What it does | Where |
|---|---|---|
| Stripe Payments Europe, Ltd. | Card payments, invoicing, VAT calculation, customer billing portal | Ireland / United States |
| NOWPayments | Cryptocurrency top-ups, only if you choose that payment method | Outside the EU |
| OVH SAS | Hosting of the platform, and of part of the deployment nodes | France (EU) |
| Hetzner Online GmbH | Dedicated servers running part of the deployment nodes | Germany (EU) |
| DataWagon LLC | Dedicated servers running part of the deployment nodes | United States |
| Cloudflare, Inc. | CDN, DDoS protection and the Turnstile anti-bot check | United States |
| Google Ireland Ltd. | Google Analytics (audience measurement) and Google Fonts | Ireland / United States |
| Discord Inc. | Sign-in with Discord, and our support community | United States |
| GitHub, Inc. | Sign-in with GitHub, and pulling the repositories you deploy | United States |
| proxycheck.io | VPN and proxy detection on referral sign-ups (anti-fraud only) | Outside the EU |
Advertising partners shown to free accounts may collect data when you interact with a promotion. Their own privacy policy applies, and is linked from the promotion.
6.3 Cookies
- Strictly necessary, always on: your session token, the sign-in security token, and the record of which account you are logged into. Without them the site cannot work, so they need no consent.
- Preferences: your theme and accent colour.
- Referral attribution: which affiliate link brought you here, so the referrer gets credited.
- Measurement: Google Analytics, subject to your consent.
6.4 How long we keep it
| Data | Retention |
|---|---|
| Account data (identity, email, preferences) | Until you delete your account |
| Invoices and payment records | 10 years, as required by French tax law |
| Application files and databases | Until you delete them, or until the account is closed |
| Backups, including the final backup we take before any deletion | Your plan's retention window (1 to 30 days) |
| Activity and security logs | 12 months |
| Referral anti-fraud records (including the IP used at sign-up) | Kept after account deletion to prevent bonus farming |
| Raw payment webhook payloads | 30 days |
6.5 Deleting your account, precisely
Deleting your account from the settings page cancels your subscription, destroys your deployments, files, databases and backups, and removes your identity, your logs and your invoices from our database. It is irreversible.
Three things deliberately survive, and you are entitled to know which:
- Invoices held by Stripe, and the accounting records derived from them, which French tax law requires us to keep for 10 years.
- An anti-fraud record of a referral sign-up, including the IP address used, so that a deleted account cannot be recreated to farm the referral bonus again.
- Moderation records, with your identity removed, where an account was actioned for abuse.
6.6 Your rights
Under the GDPR you may ask us to give you a copy of your data, correct it, delete it, hand it to another provider, restrict how we use it, or object to a processing based on our legitimate interest. Where processing rests on your consent, you may withdraw it at any time.
Write to [email protected]. We answer within one month. If our answer does not satisfy you, you may complain to the French data protection authority, the CNIL, at cnil.fr, or to the authority of the EU country where you live.
6.7 Security and children
Traffic is encrypted in transit, deployments are isolated in containers, access to production is restricted, and no employee reads your content outside of the abuse cases described in section 1.5. If a breach ever affects your personal data, we notify the CNIL within 72 hours and we tell you directly where the law requires it. The service is not aimed at children under 15, and we delete any account we find to belong to one.
7. Contact
One human reads all of these. Email is the official channel, and the only one that is binding for a legal notice, a refund request or a GDPR request.
